These Terms and Conditions explain the rules for accessing and using SIGE.chat, including its AI-powered chatbot, booking, inquiry support, landing page builder, dashboard, and related services.
1. Acceptance of Terms
By accessing or using SIGE.chat, creating an account, subscribing to a plan, using a chatbot, creating a landing page, or interacting with any part of the platform, you agree to these Terms and Conditions. If you do not agree, you should not use the platform.
2. About SIGE.chat and the Operator
SIGE.chat is operated by Ten X Development Corporation ("we", "us", "our"), a corporation registered in the Philippines. SIGE.chat is an AI-powered chatbot, booking, inquiry support, and landing page builder platform for small and medium enterprises, freelancers, and service-based businesses. The platform is designed to help users respond to inquiries, capture leads, manage bookings, and present business information online.
3. Eligibility and Account Registration
You must provide accurate, complete, and updated information when creating or managing an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
If you use SIGE.chat on behalf of a business, organization, or client, you represent that you have authority to accept these Terms and use the platform for that business, organization, or client.
4. User Responsibilities
You are responsible for the information, content, settings, business details, chatbot instructions, landing page content, uploaded materials, customer communications, bookings, offers, prices, and other materials that you submit or configure through SIGE.chat.
- Use the platform only for lawful business purposes.
- Provide accurate business, service, pricing, and contact information.
- Maintain any permissions, licenses, registrations, or authorizations required for your business.
- Review chatbot responses, landing page content, and customer-facing messages for accuracy.
- Ensure that published landing pages, chatbot messages, promotions, claims, prices, business hours, offers, and service descriptions are accurate, lawful, and not misleading.
- Comply with applicable consumer, privacy, tax, advertising, industry, and business laws.
5. Acceptable Use
You must not use SIGE.chat to engage in illegal, harmful, abusive, deceptive, or unauthorized activities. Prohibited uses include, but are not limited to:
- Submitting false, misleading, infringing, defamatory, abusive, or unlawful content.
- Using the platform to sell or promote illegal goods, regulated products without authorization, scams, fraud, or deceptive services.
- Attempting to access accounts, systems, data, or services without authorization.
- Uploading malware, malicious code, spam, or harmful automated requests.
- Interfering with platform security, performance, availability, or integrity.
- Using SIGE.chat in a way that violates the rights of customers, end-users, third parties, or applicable law.
Users should not submit, request, or collect sensitive personal information through SIGE.chat unless they have a valid lawful basis, proper notice, required consent or authority, and appropriate safeguards.
6. AI-Generated Responses and Platform Output
SIGE.chat may use AI-powered features to generate chatbot responses, organize inquiries, support booking flows, and help users create or manage online content. AI-generated responses may not always be complete, accurate, current, or appropriate for every situation.
You are responsible for reviewing and managing your chatbot instructions, business information, customer-facing responses, and landing page content. SIGE.chat should not be used as a substitute for professional legal, medical, financial, tax, or other regulated advice.
7. Customer Inquiries and Business Transactions
SIGE.chat may help users receive and manage customer inquiries, booking requests, and lead information. Any sale, service agreement, booking, appointment, refund, cancellation, delivery, fulfillment, or customer dispute between a business user and their customer remains the responsibility of the business user, unless otherwise stated in a separate written agreement.
8. Subscriptions, Pricing, and Billing
SIGE.chat may offer free, beta, trial, paid, promotional, monthly, annual, prepaid, or custom subscription plans. Plan inclusions, usage limits, prices, billing cycles, renewal terms, and available features may be shown on the website, checkout page, invoice, dashboard, or separate agreement.
By subscribing to a paid plan, you authorize SIGE.chat, its affiliated companies, or its authorized payment partners to process the applicable charges based on your selected plan and billing cycle. The entity charging you, and the applicable payment processor, will be shown at checkout, on your invoice, or on your receipt. You are responsible for keeping your billing and payment information accurate and updated.
Prices may be displayed and charged in Philippine Pesos (PHP), US Dollars (USD), or other supported currencies, depending on your country and payment method, as shown at checkout. If your payment method settles in a different currency, your bank, card issuer, e-wallet, or payment provider may apply its own exchange rates, currency conversion charges, or foreign transaction fees, which are your responsibility.
Renewal terms depend on the payment method and plan selected. Where recurring billing is supported and enabled, paid subscriptions renew automatically according to the selected billing cycle unless cancelled before the next billing date. Prepaid plans, including plans paid through QR or e-wallet channels, may expire at the end of the selected billing period unless renewed or topped up. The applicable renewal mechanics will be shown at checkout, in your plan terms, or in your account dashboard.
Plans may include usage limits, message limits, conversation limits, AI usage limits, storage limits, rate limits, or feature limits. SIGE.chat may enforce these limits automatically or manually to protect service quality and prevent abuse. If a plan limit is reached, affected features may be paused, reduced, or limited until the next billing period, a renewal, or an upgrade.
If you upgrade, downgrade, or change plans, the change may take effect immediately or at the next billing cycle, as shown at checkout or in your account dashboard. Downgrading may reduce available features, limits, or stored content.
Free trials, beta features, and promotional plans are provided for evaluation purposes, may be subject to additional limits or eligibility requirements, may change or end at any time, and are provided without any guarantee of continued availability.
If a paid plan expires or applicable fees are not paid, SIGE.chat may limit, suspend, or disable paid features, including chatbots and published landing pages, and may archive or remove associated content after a reasonable notice period, subject to applicable law.
9. Taxes
Prices may be exclusive or inclusive of applicable taxes, such as value-added tax or similar sales, goods and services, or digital services taxes in your jurisdiction, as shown at checkout, on the invoice, or in a separate agreement. You are responsible for applicable taxes unless otherwise stated.
10. Payment Processing
Payments may be processed through Xendit or other authorized payment partners. Payments by customers in Japan may be processed through Stripe by our Japan-based affiliate. Payment providers may process payment-related information according to their own terms, privacy policies, compliance requirements, and security standards.
SIGE.chat may store transaction references, invoice records, plan details, billing status, payment confirmations, and related account records. SIGE.chat does not directly store complete card numbers, CVV codes, or sensitive payment credentials. Payment credentials are handled by authorized payment processors, subject to their applicable terms and security standards.
11. Refunds and Cancellations
Refunds and cancellations are handled according to the SIGE.chat Refund Policy, the terms shown during checkout, any applicable plan terms, and applicable law. Cancellation generally stops future renewal charges but does not automatically refund amounts already paid unless a refund is approved under the Refund Policy.
12. User Content and Intellectual Property
You retain ownership of content that you submit to SIGE.chat, such as business descriptions, service details, landing page text, uploaded media, chatbot instructions, and customer-facing content, subject to any rights granted to SIGE.chat to operate and provide the platform.
By submitting content to SIGE.chat, you grant SIGE.chat a limited right to host, process, display, transmit, format, and use that content as necessary to provide, maintain, secure, and improve the services. You represent that you have the rights and permissions needed to submit and use such content.
13. SIGE.chat Intellectual Property
SIGE.chat, including its platform, design, software, features, workflows, branding, logos, documentation, content, and related materials, is owned by Ten X Development Corporation or its licensors. You may not copy, modify, reverse engineer, resell, or misuse the platform except as permitted by these Terms or by written authorization.
14. Privacy and Data Protection
SIGE.chat processes personal data according to its Privacy Policy. By using the platform, you acknowledge that personal data may be collected, used, stored, shared, and protected as described in the Privacy Policy and as required to provide the services.
Business users are responsible for ensuring that they have the proper legal basis, consent, notice, or authority to collect and process customer or end-user data through their chatbots, forms, landing pages, booking flows, and customer communications.
15. Data Processing on Behalf of Business Users
Where SIGE.chat processes the personal data of a business user’s customers or end-users on the business user’s behalf — such as chatbot conversations, inquiries, bookings, and leads — the business user is the personal information controller and SIGE.chat is the personal information processor, as described in the Privacy Policy. For that processing, this Section forms the data processing agreement between the business user and Ten X Development Corporation under the Philippine Data Privacy Act of 2012 and its implementing rules, and SIGE.chat agrees that it will:
- process such data only to provide, operate, maintain, secure, support, and improve the services, in accordance with these Terms and the business user’s configuration of the platform, which together constitute the business user’s documented instructions;
- ensure that persons authorized to process such data are bound by appropriate confidentiality obligations;
- protect such data using the security measures described in the Privacy Policy;
- engage subprocessors (such as hosting, infrastructure, analytics, AI, and payment providers, as described in the Privacy Policy) only under data protection obligations no less protective than this Section, remaining responsible for their performance;
- provide reasonable assistance with verified data subject requests and with the business user’s security and breach-notification obligations, where these cannot be handled through the platform’s existing features;
- notify the business user without undue delay upon becoming aware of a personal data breach affecting such data; and
- upon account termination or verified request, delete or return such data within a reasonable period, except where retention is required by law or by the Privacy Policy’s retention provisions.
The business user remains responsible for the lawfulness of the data it collects through the platform, as stated in Section 14. International transfers and SIGE.chat’s commitment not to use conversation data to train foundation models are as stated in the Privacy Policy.
16. Third-Party Services
SIGE.chat may integrate with or rely on third-party services such as payment processors, hosting providers, analytics tools, messaging services, email services, AI providers, and other technology partners. Third-party services may be governed by their own terms and privacy policies. SIGE.chat is not responsible for third-party services outside its reasonable control.
17. Service Availability and Changes
SIGE.chat aims to provide a reliable and useful service, but the platform may be unavailable from time to time due to maintenance, updates, technical issues, security incidents, third-party provider outages, or events beyond our control. We may update, improve, suspend, limit, or discontinue features as needed.
18. Suspension, Content Removal, and Termination
SIGE.chat may suspend or terminate access to the platform if we believe that an account has violated these Terms, created legal or security risk, caused harm to the platform or others, engaged in fraud or abuse, failed to pay applicable fees, or used the service in an unauthorized manner.
SIGE.chat may remove, unpublish, or disable landing pages, chatbots, or other content that we reasonably believe is unlawful, deceptive, harmful, or in violation of these Terms.
You may stop using SIGE.chat at any time. Certain obligations, including payment obligations, intellectual property protections, disclaimers, limitations of liability, and legal compliance obligations, may survive account cancellation or termination.
19. Disclaimers
SIGE.chat is provided on an as-is and as-available basis to the fullest extent permitted by law. We do not guarantee that the platform will be uninterrupted, error-free, completely secure, or always accurate. We do not guarantee any specific business result, number of leads, sales, bookings, revenue, conversion rate, or customer outcome.
20. Limitation of Liability
To the fullest extent permitted by law, SIGE.chat, Ten X Development Corporation, and their directors, officers, employees, contractors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or customer disputes arising from or related to the use of the platform.
Nothing in these Terms limits rights or remedies that cannot be limited under applicable law.
21. Indemnity
You agree to defend, indemnify, and hold harmless SIGE.chat, Ten X Development Corporation, and their directors, officers, employees, contractors, service providers, and partners from claims, damages, liabilities, losses, costs, and expenses arising from your use of the platform, your content, your business operations, your violation of these Terms, your violation of law, or your violation of third-party rights.
22. Governing Law and Dispute Venue
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles. Any legal action shall be brought before the proper courts of Quezon City, Philippines, unless applicable law requires otherwise or a separate written agreement states otherwise.
If you use SIGE.chat from outside the Philippines, you are responsible for complying with the laws that apply to you locally. If the mandatory consumer protection laws of your country grant you rights, remedies, or a venue that cannot be limited by agreement, nothing in these Terms limits those mandatory protections.
23. Updates to These Terms
SIGE.chat may update these Terms from time to time to reflect changes in the platform, business operations, legal requirements, payment processes, or policies. The updated version will be posted with a revised effective date. Continued use of the platform after updates means you accept the updated Terms.
